Terms of Service

Effective date: August 14, 2026 · Version 2026-08-14

These Terms of Service ("Terms") govern business access to and use of HelpDraft, operated by Bluman sp. z o.o. By creating a workspace, connecting a communication channel or using the service, the business accepting these Terms (the "Customer") agrees to them and confirms that its representative is authorized to act for it.

1. The Service

HelpDraft is a multi-tenant relationship communication platform. Depending on the selected plan and rollout status, it can provide customer conversations, relationship context, assisted drafting, follow-ups, company knowledge, customer spaces, email, SMS, WhatsApp, managed phone numbers, content and operational tools. Feature availability may differ by country, provider approval, account status and plan.

2. Accounts, roles and security

The Customer is responsible for accurate account and business information, authorized users, role assignments and the security of its email accounts, one-time codes, device PINs and connected business accounts. Credentials and verification codes must not be shared. Suspected unauthorized access must be reported promptly.

3. Customer data and privacy roles

The Customer retains its rights in content and business data supplied to HelpDraft. It grants HelpDraft a limited right to process that data only as needed to provide, secure and support the service and as otherwise documented in the agreement. For personal data the Customer controls, the Customer determines the purpose and lawful basis and HelpDraft normally acts as processor. The Privacy Policy and any applicable data-processing terms form part of these Terms.

The Customer must provide legally required notices, handle data-subject requests and avoid uploading data that is unnecessary for the selected purpose. HelpDraft will provide reasonable processor assistance where applicable.

4. Communications, consent and acceptable use

The Customer is responsible for the recipients, purpose, content, timing and lawful basis of its communications. It must maintain evidence of required opt-in, respect opt-outs and suppression lists, use approved templates where required and comply with applicable privacy, electronic communications, telemarketing and consumer-protection law.

The Customer must not use HelpDraft to:

  • send spam, phishing, deceptive, unlawful or unsolicited communications;
  • circumvent consent, opt-out, rate-limit, template, quiet-hour or provider restrictions;
  • promote prohibited goods, services or conduct under applicable Meta, WhatsApp, Telnyx or carrier policies;
  • upload unlawful, infringing, malicious or unnecessarily sensitive content;
  • harass, discriminate, impersonate, exploit vulnerable people or make high-impact decisions without appropriate human responsibility;
  • probe, reverse-engineer, bypass or interfere with security, tenant isolation or service limits.

HelpDraft may block, rate-limit or suspend affected messages, channels or accounts where reasonably necessary to protect users, providers, deliverability, security or legal compliance.

5. Meta, WhatsApp and connected providers

When connecting WhatsApp, the Customer authorizes HelpDraft and the relevant communications provider to perform the requested onboarding and messaging operations for the Customer's WhatsApp Business Account (WABA). The Customer must accept and comply with applicable Meta and WhatsApp terms and policies and must maintain an eligible, accurate and authorized business account.

Provider approval, display names, templates, account quality, message delivery and channel availability are controlled in part by Meta, carriers and communications providers. HelpDraft cannot guarantee approval or uninterrupted provider service and may be required to apply a provider suspension immediately.

Where HelpDraft allocates a managed telephone number, the number remains provisioned under HelpDraft's or its provider's account and is licensed for the Customer's use while the managed service is active. The Customer does not receive provider-portal credentials or ownership of HelpDraft's master account. Porting or continued use after termination is subject to the plan, applicable law, provider capability, account standing and completion of required verification and charges.

6. AI-assisted features and human responsibility

HelpDraft can prepare drafts, summaries, classifications, translations and recommendations. AI output may be incomplete or incorrect. The Customer remains responsible for reviewing outputs and deciding what is sent or acted upon. HelpDraft is not a medical, psychological, legal, financial or other licensed professional adviser. Sensitive, unusual or high-impact matters require qualified human judgment.

HelpDraft does not intentionally use one Customer's raw communications to train a shared model for another Customer. Provider processing is described in the Privacy Policy.

7. Billing, provider charges and taxes

Prices, recurring fees, usage charges, number costs, registration fees and applicable taxes are shown in the order flow, plan or separate commercial terms. Some provider or regulatory fees are non-refundable once a registration, verification or number order has been submitted. Recurring services continue until cancelled in accordance with the selected plan. Failed payment may pause paid capabilities while preserving data as required by the agreement and law.

8. Intellectual property

HelpDraft software, interfaces, documentation and platform architecture remain the property of Bluman sp. z o.o. or its licensors. Customer content remains the Customer's property. Feedback may be used to improve HelpDraft without identifying confidential Customer information. Third-party services and content remain subject to their own terms.

9. Availability, changes and beta capabilities

We aim to provide a reliable service but do not promise that every capability will be continuously available. We may change or discontinue a feature for security, provider, regulatory or product reasons. Material changes affecting paid service will be communicated where reasonably practicable. Preview or staged capabilities may have additional limits and must not be relied on for critical operations without an agreed production status.

10. Suspension and termination

Either party may terminate as allowed by the plan or agreement. HelpDraft may suspend access for material breach, unlawful use, security risk, non-payment or provider instruction. On termination, channel processing stops and Customer data is exported, retained or deleted under the agreement, Customer instructions, the Privacy Policy and applicable law. Meta/WhatsApp deletion instructions are available at helpdraft.com/data-deletion.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided without warranties not expressly stated in an applicable written agreement. Bluman sp. z o.o. is not liable for indirect, incidental, special or consequential loss, including lost profits, business interruption or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded. Any negotiated order form or enterprise agreement controls where it expressly differs from these Terms.

12. Governing law

These Terms are governed by Polish law. Disputes between businesses are subject to the competent courts in Warsaw, unless mandatory law or a separate written agreement requires otherwise. Mandatory rights that cannot be waived remain unaffected.

13. Changes to these Terms

We may update these Terms as the service, providers or law changes. We will publish the new effective date and provide appropriate notice of material changes. Continued use after the effective date constitutes acceptance where permitted by law.
